March 30, 2004 - Bill C45: Legal Duties on Employers/Employees

Did you know that effective March 31, 2004, in Canada, that through Federal Bill C-45:

• company health and safety programs now require a higher level of accountability
• health & safety negligence is a crime that results in a permanent criminal record
• the fine for a 'summary conviction' is $100,000; there are no ceilings for fines on 'indictable' or more serious offences; there is a maximum penalty of life imprisonment
• foremen, lead hands, supervisors and workers all have important legal duties
• the Bill casts its net wider than any current Occupational Health & Safety legislation

When reviewing the information, ask yourself: Can Distributors and Distributor Sales Representatives be criminally charged for selling cleaning chemicals knowing that there were safer alternatives?

Upon your review, you will note that if a company knowingly uses, or allows to be used in their facility, harmful cleaning chemicals and someone is injured, the company and all who direct the employee or Building Service Contractor can be criminally charged.
While this is a new Canadian Federal law, for the US Distributors and Sales Representatives, you can still use it as a reference to show what Canada has recently initiated.
This new Bill should open many doors for you wanting to introduce Enviro-Solutions products, in particular to the larger companies and organizations, especially ones unionized, ISO 14001 or 18002 Certified.
Another key target should be progressive Building Service Contractors that want to communicate the fact that they use safer cleaning chemicals to help differentiate themselves from their competitors.
